Shuswap MLA's family firm sued for alleged refusal to return $90K deposit

A BC houseboat company run by the family of BC United Shuswap MLA Greg Kyllo is being sued by a former client who alleges the firm refused to pay back a $90,000 deposit. According to a July 19 Notice of Claim, Revelry Lodgings claimed modular home company Twin Anchors Manufacturing owed it $90,550 after it paid a deposit for work that never went ahead. "In breach of its fiduciary duty to the (Revelry Lodgings) and in breach of trust, Twin Anchors has failed to return the deposit to (Revelry Lodgings). Instead, it has misappropriated the deposit for its own use," the Notice of Claim said. Twin Anchors Manufacturing has since changed its name to Kyllo Homes, which is part of a family of companies including the well-known Twin Anchors Houseboat Vacations. According to Kyllo Homes website, Greg Kyllo is the company CEO. The cost was $197,625 and Revelry Lodgings put down a $90,550 deposit so work on the structure could begin. "It was an implied term of the contract that any price changes arising from changes in the scope of work would be reasonable," the Notice of Claim said. The Notice of Claim said in the weeks following, Revelry Lodgings decided the building was no longer viable for its business. "The reasons for this determination included Twin Anchors' failure to provide plans for the Structure approved by a qualified engineer, with the result that the (Revelry Lodgings) could not obtain a building permit for the Structure," the court document said. Months later, Revelry Lodgings told Twin Anchors it wasn't going ahead and asked for the deposit back minus whatever costs had occurred. It also failed or refused to provide any information concerning costs or expenses that it had incurred with respect to the structure," the court document said. The Notice of Claim said Twin Anchors never started work on the structure. Revelry Lodgings claims that Twin Anchors has "failed or refused" to return the deposit. The Revelstoke company is suing for $90,550, plus interest. Kyllo didn't immediately respond to a request of comment. Twin Anchors Manufacturing has not filed a response to the suit and did not return a request for comment by press time.
