To no one’s surprise, serial protester David Lindsay did not show up to court today for his sentencing on assault and contempt of court charges.
Instead, Lindsay’s girlfriend arrived to tell Provincial Court Judge Cathaline Heinrichs that she drove Lindsay to hospital around 5 a.m., that he was still there and she refused to elaborate.
“I am not allowed to release any more information,” she said.

Lindsay, who contends to have written books about the law and considers himself a legal expert of sorts, has created several hiccups in the timing of his trials, arguments and other complaints about the legal process, including the charge of contempt for refusing an order of the judge.
The underlying reason for his crime — “assaulting” an Interior Health security guard during pandemic lockdowns — was to disrupt and obfuscate authorities of all kinds. Lindsay is a ringleader for a loose collection of anti-authority and specifically anti-vaccination and anti-pandemic response mandates.
Heinrichs was reluctant to accept what she heard and conferred with the Crown to get more information. Prosecutor Dave Grabavac asked a police officer to investigate and indeed they found him at Kelowna General Hospital, connected to IVs and complaining of some pain.

That still wasn’t enough for Heinrichs who ordered, through his girlfriend, that he provide some explanation from a doctor before noon today, which he did, saying he would be hospitalized for 24 hours.
Now the sentencing has been put off to yet another date. Meanwhile, Lindsay has already filed appeals of Heinrichs’ rulings but still awaits hearing dates.
